COMMISSIONING AN ARTWORK & TERMS AND CONDITIONS
How do I commission a piece from you?
1. Complete a Commission Request Form with your request and send any references (e.g. photos) to Louise McLoughlin Art.
2. You will then receive a written Artwork Proposal from Louise for the work, including costs and timescales for completion.
3. You confirm in writing that you accept the Proposal or request any adjustments.
4. You pay the deposit (50%).
5. Work will commence after the deposit is received.
6. Once work has commenced, Louise McLoughlin Art will email photos of the progress of the Artwork & an estimated completion date. At this ‘Early Development’ stage, minor alterations can be made to its design content.
7. Once Artwork is complete Louise McLoughlin Art will email the Client a watermarked digital photo of the finished portrait. At this point only small changes or details can be requested and these will be completed at the discretion of the artist.
8. On acceptance of the finished Artwork payment for the full amount is required.
9. On receipt of full payment you’re Artwork will be delivered by the agreed method.

TERMS & CONDITIONS
The following terms and conditions apply to the commissions service provided by Louise McLoughlin Art to you, the Client.
Acceptance
It is not necessary for the Client to have signed any document for these terms and conditions to apply. If the Client commissions an Artwork from Louise McLoughlin Art then the Client will be deemed to have satisfied themselves as to the terms applying and have accepted these terms and conditions in full.
Please read these terms and conditions carefully. Any commission or use services implies that you have read, understood and accepted these terms and conditions.
Price Quotations
Charges for services to be provided by Louise McLoughlin Art are defined in the price quotation that the Client will receive, upon request, via email. Quotations are valid for a period of 30 days. Louise McLoughlin Art reserves the right to alter or refuse to honour a quotation after expiry of the 30 days.
Additional Expenses
The Client agrees to reimburse Louise McLoughlin Art for any additional expenses incurred for the completion of the work. Examples of these instances would be postage charges, extra travel expenses for delivery etc. If these apply, these will be agreed in advance with the Client.
Photo Provision
The Client will be required to provide suitable photographs for the commission work to be produced. The Client must have permission to use such photographs & it is their responsibility to not breach any copyright laws.
Artwork progress and commissioning process
Prior to work commencing on your Artwork, you will be asked to complete a Commission Request Form outlining your requirements. Once submitted to Louise McLoughlin Art your commission requirements will be reviewed and a proposal and quotation will be provided.
On acceptance of the proposal and quotation the agreed deposit becomes payable. Work will not begin in your Artwork until the deposit has been received.
Once work commences on a Clients Artwork, Louise McLoughlin Art will email and Early Development update and photos of the progress of the Artwork & an estimated completion date. At this stage minor alterations can be made to its design content.
Louise McLoughlin Art reserves the right to share “painting in progress” photos to social media unless the Client expresses this not to be done. eg a surprise present.
Once the Artwork is complete Louise McLoughlin Art will email the Client a watermarked digital photo of the finished portrait. At this stage only very minor adjustments can be made and are subject to the agreement of Louise McLoughlin.
Copyright
Louise McLoughlin Art retains the copyright to the artwork created from the Clients photo. Louise McLoughlin Art will not reproduce the Artwork & its usage will not be allowed on any other website apart from Louise McLoughlin Art website and social media pages, unless the Client gives written permission to do so.
Louise McLoughlin Art reserved the right to display the artwork on their website and social media pages. If a Client is unhappy about the artwork being displayed, they must declare this upon placing the commission.
The Client retains ownership of the artwork and can share and display the Artwork digitally and physically for personal but not commercial use. If the client wishes to make any reproductions of the Artwork then this must be arranged through Louise McLoughlin Art only.
Deposit
Louise McLoughlin Art requires a 50% deposit from the Client to confirm a commission slot. This deposit is non refundable.
Payments
Invoices will be issued by Louise McLoughlin Art upon completion of the Artwork & before collection/delivery. Invoices are primarily sent via email. The Client will also be required to provide a current postal address to receive hard copy invoices. Payment in full is due within 7 days of invoice.
Your Artwork will be dispatched once payment in full has been received by Louise McLoughlin Art.
Please note, unless specifically agreed to by both parties prior to the issuing of an invoice, Louise McLoughlin Art does not accept payment in part or via instalments.
Louise McLoughlin Art accepts payment by the following methods (in order of preference):
Bank Transfer (BACS)
Credit/Debit Card*
PayPal*

For termination before completion of commission
If the client chooses to terminate the services of Louise McLoughlin Art after agreeing a commission arrangement but before the commissioned project is complete, Louise McLoughlin Art reserves the right to retain any non-refundable deposits paid.
Should the Client cancel the commission agreement after the Artwork has been completed, Louise McLoughlin Art reserves the right to charge up to 85% of the total projected costs. The scale of the charge will be dependent on the discretion of Louise McLoughlin Art and the stage of the project at the time of cancellation.
If communication breaks down on the part of the Client for a period of 30 days (that is, the Client fails to reply to a communication from Louise McLoughlin Art ) Louise McLoughlin Art will issue a warning email. If this warning email is not replied to (and communication does not resume) with a following period of 30 days, Louise McLoughlin Art reserves the right to to terminate the commission. In this event, all deposits paid will be retained by Louise McLoughlin Art and the commission will be cancelled.
If the Client wishes to continue the commission at a later date they will be required to request a new project quotation, sign a new Commission Agreement and pay a further non-refundable deposit.
Disputes
It is the responsibility of Louise McLoughlin Art to act in good faith to meet your requirements outlined in your Commission Request Form and outlined in the Proposal.
It is the Client’s responsibility to provide accurate requirements and to approve work that meets these requirements at the Early Development stage. In the unlikely event that work is not to requirements on completion the Client is advised that disputes can only be considered if the Artwork does not meet requirements outlined in the Commission Request Form or deviance from an accepted Artwork Proposal.
If the completed Artwork does meet Client Requirements but despite good faith on both parties cannot be accepted for a reason that the Artist accepts, then the Artist will retain 50% of the Deposit and retain ownership and rights over the completed Artwork
